Terms and Conditions for Forest Character Validation

 

These terms and conditions ("Agreement") govern the submission of forest details and data ("Forest Information") by the landowners ("Owners") to Fusionpact Technologies Private Limited ("Fusionpact") for the purpose of validating the characteristics of the forestland. By submitting the Forest Information through the provided Google Form, the Owners agree to be bound by these terms and conditions.

 

Forest Information Submission: 

 

a. The Owners shall complete the provided Google Form accurately and provide all requested details regarding their forestland. 

b. The Owners shall provide true, current, and complete information to the best of their knowledge.

 

Validation Process: 

 

a. Fusionpact shall use its proprietary platform, Foresttwin™, along with terrestrial and other forms of lidar drone and IoT technologies to accurately estimate the forest characteristics based on the submitted Forest Information. 

 

b. Fusionpact shall use commercially reasonable efforts to ensure the accuracy of the validation process. 

 

c. The validation data generated by Fusionpact shall be shared with the Owners to aid in determining the suitability of the forestland for specific carbon registries 

 

Ownership and Use of Forest Information: 

 

a. The Owners retain all ownership rights to the Forest Information submitted by them. 

 

b. Fusionpact shall have the non-exclusive, worldwide, royalty-free right to use the Forest Information for the purpose of forest validation and determining suitable Carbon registry projects. 

 

Reliance on Validation Data: 

 

a. The Owners acknowledge that the validation data generated by Fusionpact is an estimate based on the submitted Forest Information and technological analysis. 

 

b. Fusionpact uses its Foresttwin™ platform for reliability of the validation data. 

 

c. The Owners agree to rely on the validation data at their own risk and shall not hold Fusionpact liable for any loss, damage, or inconvenience arising from the use of the validation data.

 

Limitation of Liability: 

 

a. Fusionpact shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the validation process or the use of the validation data. 

 

b. The total liability of Fusionpact, whether in contract, tort, or otherwise, shall be limited to the amount paid, if any, by the Owners to Fusionpact for the forest validation services.


 

Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Uttar Pradesh.
